§ 2.03.030. Director—Powers.

  • The department will be directed, administered and supervised by the director of the department. The director will be empowered to assert administrative and policy-making authority over the department in accordance with applicable provisions of the Clark County Code and state statutes, and all other licensing laws, ordinances, rules and regulations adopted by the board of county commissioners and/or the liquor and gaming licensing board.

    (a)

    The director will provide primary staff support to the county liquor and gaming licensing board;

    (b)

    The director will be the "county license collector" pursuant to state statutes;

    (c)

    The director will be responsible for developing, maintaining, updating, and enforcing the licensing provisions of the Clark County Code;

    (d)

    The director will be responsible for enforcing the licensing provisions of state statutes, and all other laws, ordinances, rules and regulations adopted by the board of county commissioners and/or the liquor and gaming licensing board related to business, liquor and gaming licensing functions;

    (e)

    The director is responsible for enforcing the licensing provisions of the Clark County Code, state statutes and all other laws, ordinances, rules and regulations adopted by the board of county commissioners and/or the liquor and gaming licensing board, by various means, including, but not limited to:

    (1)

    Issuance of notices of violation and misdemeanor citations,

    (2)

    Issuance of temporary licenses and/or non-privileged licenses with reasonable conditions as permitted by law; and

    (3)

    Denial of an application for a non-privileged business license;

    The foregoing actions by the director shall be based upon the following:

    (A)

    Violations of the licensing provisions of the Clark County Code, state statutes, and all other licensing laws, ordinances, rules and regulations adopted by the board of county commissioners, and/or

    (B)

    When applicable, an applicant's personal history financial history, licensing history, regulatory history, and/or area of concerns identified by the LVMPD and/or an agent of the department;

    (f)

    The director shall develop administrative procedures, ordinances, rules and regulations to effectively and efficiently enforce the licensing provisions of the Clark County Code, state statutes, and all other licensing laws, ordinances, rules and regulations adopted by the board of county commissioners and/or the liquor and gaming licensing board, or delineated in Clark County Code; and

    (g)

    The county manager shall provide direction, supervision, and administrative oversight to the director for administrative, budgetary, and human resource purposes and for policies and procedures as established by the board of county commissioners.
