§ 12.16.040. Exceptions.

  • In all cases wherein a prosecution may be had for a violation of this chapter, it must be shown that the person alleged as falsely reporting any fire, disaster, accident, crime or commission of a crime must have known, or have had reasonable basis for knowing, that the incident reported or alleged was false. Nothing in this chapter shall be construed in such manner as to cause the prosecution of any person who has falsely reported any fire, disaster, accident, crime or criminal activity under mistake of fact, when it can be shown that such report or allegation was made in good faith.
