§ 7.50.020. Definitions.

For purposes of Chapter 7.50, inclusive, unless the context otherwise requires, the words and terms set out below:

(a)

"Bicycle" means a device upon which persons may ride, having two tandem wheels, or every such device generally recognized as a bicycle though equipped with one or more front or one or more rear wheels. A bicycle is not a moped.

(b)

"Department" means the Clark County department of business license.

(c)

"Director" means the director of the Clark County department of business license.

(d)

"Highway(s)" means that portion of any public street, road, highway, boulevard, lane, avenue, drive or way, located within the unincorporated areas of Clark County that is open for use by the general public for the purpose of vehicular travel.

(e)

"Operator" means any person who operates a pedicab, including a person entitled to the use and possession of a pedicab under a lease or contract for the purpose of transporting one or more passengers and/or property.

(f)

"Owner" means sole proprietor or any individual holding ten percent or more of the partnership, stock, or membership units of any form of business entity.

(g)

"Pedicab" means:

(1)

A bicycle that has three or more wheels, that transports, or is capable of transporting, passengers on seats attached to the bicycle, that is operated by one or more persons, whether human propelled or motor assisted, and that is used for transporting passengers or property; or

(2)

A bicycle that pulls or pushes a trailer, sidecar, or similar device, that transports, or is capable of transporting passengers on seats attached to the trailer, sidecar, or similar device, that is operated by one or more persons whether human propelled or motor assisted and that is used for transporting one or more passengers or property.

(h)

"Pedicab business" means a commercial enterprise, that employs or contacts with one or more operator(s), that engages in providing transportation via pedicab, for any form of compensation including gratuities and/or donations, on either public or private property, or both.

(i)

"Principal" means sole proprietor; or, in the case of a corporation, each shareholder owning or controlling ten percent or more of the outstanding shares of the corporation, and the principal officers of the corporation, including the president, secretary, and treasurer; or, in the case of a limited liability company, each member owning or controlling ten percent or more of the units of the company, and the manager(s); or, in the case of a partnership, each partner; or, in the case of an association, each member of the association.
