§ 3.30.040. Elected town advisory boards—Terms—Appointment of members under certain circumstances.

  • (a) The term of office for an elected town advisory board member is two years. The members of an elected town advisory board shall first be elected at the general election in 2016 with the term of office commencing on the first Monday in January next following their election.

    (b)

    If no more than the number of candidates to be elected has filed for election to an elected town advisory board, the candidates who filed shall be declared elected and no election will be held for that office. If fewer qualified candidates file for election to the elected town advisory board than the number to be elected, then the board of county commissioners shall appoint as many members as are necessary to fill the seats left vacant.

    (c)

    If more than the number of candidates to be elected has filed for election to an elected town advisory board, up to but not exceeding twice the number of candidates to be elected, then that contest will not appear in the Primary Election, only in the General Election.

    (d)

    If more than twice the number of candidates to be elected has filed for election to an elected town advisory board, then that contest and the names of all of the qualified candidates will appear in the Primary Election. The candidates receiving the highest number of votes, not exceeding twice the number of to be elected, will appear on the General Election ballot. If one candidate receives a majority of the votes cast in the Primary Election, then that candidate will be declared elected and his or her name will not appear in the General Election.

    (e)

    Members of an elected town advisory board do not serve at the pleasure of the board of county commissioners and cannot be removed by the board of county commissioners.
