§ 20.11.010. Definitions.

  • (a) The terms defined in Section 158.3 of the Regulations have the meanings ascribed to them in that section of the Regulations for the purposes of this Chapter 20.11.

    (b)

    The following terms have the meanings ascribed to them in this subsection for the purposes of this Chapter 20.11:

    (1)

    "Act" means the Aviation Safety and Capacity Act of 1990 (Pub. L. 101-508, Title II, Subtitle B), enacted on November 5, 1990 by the United States.

    (2)

    "Approval" means the approval of the county's request to impose a PFC evidenced by letter from the acting Administrator to the director of aviation dated February 24, 1992; such term also includes any and all future approvals by the FAA of applications to impose, to use, or to impose and use a PFC by the county, including, without limitation, such approvals which amend or alter the February 24, 1992 letter, approval of additional projects for which PFC's can be used or imposed and used, and approvals which extend the time during which the PFC can be imposed.

    (3)

    "Administrator" means the Administrator of the FAA or his successor in functions, if any, and such term includes any acting Administrator.

    (4)

    "FAA" means the Federal Aviation Administration of the Department of Transportation of the United States.

    (5)

    "Regulations" means the Regulations issued under the Act on May 22, 1991, cited as Part 158 of the Federal Aviation Regulations, 14 CFR Part 158, as amended from time to time.

    (c)

    The definitions provided in this section shall override any inconsistent definitions provided in Section 20.04.010 of the Clark County Code for the purposes of this Chapter 20.11 only, but the definitions in Section 20.04.010 shall apply for the purposes of this chapter if the definitions are not inconsistent with the definitions provided in this section.
