§ 15.30.090. Additional regulations.

  • The following additional regulations apply to highway transportation within the county of the hazardous materials specified in Section 15.30.025(B):

    (A)

    Traffic violations by carriers transporting hazardous materials shall be treated as violations of these regulations and shall be subject to the penalties of Section 15.30.120 herein.

    (B)

    Those portions of public highways and streets within the unincorporated towns of Paradise, Winchester, Spring Valley, Sunrise Manor and East Las Vegas are conclusively presumed to be routes which go through or near heavily populated areas, therefore, the use of said routes, except major thoroughfares as defined in Section 15.30.090(C) for the transportation of hazardous materials as defined in Section 15.30.025(B) is prohibited where there is neither a point of origin, destination (delivery point) nor handling within those unincorporated towns.

    (C)

    For the purposes of this chapter, the following are considered to be major thoroughfares:

    (1)

    Alternative routes designated by the Board of Directors of the Nevada Department of Transportation;

    (2)

    In the absence of designated alternative routes, the preferred routes designated in the regulations of the United States Department of Transportation;

    (3)

    In the absence of designated alternative or preferred routes, routes selected by the carrier applying the criteria set forth in Title 49 of the Code of Federal Regulations, Section 177.825.

    (D)

    Headlights shall be illuminated at all times.
