§ 8.60.260. Emergency temporary suspension.

  • (a) The director may issue an emergency temporary suspension order on any business licensed under the provisions of this chapter of the Code, for cause, or upon documented Code violations, or upon specific acts which endanger the public welfare, where such emergency temporary suspension is deemed necessary for the immediate preservation of the public peace, health, health, safety, order, or welfare.

    (b)

    The emergency temporary suspension order shall be delivered to the licensee and must set forth in writing the grounds upon which it is issued, including a statement of facts constituting the alleged emergency necessitating such temporary suspension. The order shall also set forth the date, time, and place for the licensee to appear before the hearing officer to show cause in the matter. The date set for the hearing shall not exceed five working days after issuance of the emergency temporary suspension order.

    (c)

    The emergency temporary suspension order is effective upon issuance and the licensee shall immediately cease operations upon delivery of the order to the business.

    (d)

    Hearings for emergency temporary suspensions shall be conducted pursuant to Section 8.60.270 of this Code.
