§ 8.20.020.300. Regional commercial retail mall.

  • "Regional commercial retail mall" means either: (A) a building or complex of interconnected buildings contained on parcels of land consisting of no less than two acres located within the Resort Entertainment Corridor that contains a minimum of one hundred eighty thousand square feet under one roof devoted to the retail offering of goods and services, and within which other consumer services are provided (e.g. food service special events fashion shows etc.) all of which share an attached parking lot; or (B) a building and/or concentration of businesses located within the Resort Entertainment Corridor that contains a minimum of one million seven hundred fifty thousand square feet contained on at least two legal parcels of land consisting of not less than forty gross acres devoted to the retail offering of goods and services, and within which other consumer services are provided (e.g., food service, special events, fashion shows, etc.), all of which share a common parking lot. The parking lot of a regional commercial retail mall must have common egress and ingress, and all landscaping and architecture must be designed in a manner that projects one common and continuous land development.

    In addition to the above, a regional commercial retail mall must contain either:

    (1)

    (a)

    A minimum of five anchor stores, which have at least one hundred fifty thousand square feet each; and

    (b)

    Common area space which excludes anchor stores and tenant space of at least two hundred thousand square feet; and

    (c)

    Audio-visual infrastructure to support live productions; or

    (2)

    (a)

    At least one restaurant with seating at tables or booths for at least two hundred patrons in dining areas physically separated by a banner sufficient to prevent minors from any bar or lounge areas in the restaurant; and

    (b)

    A minimum of one commercial enterprise having at least forty thousand square feet (i.e., retail store, movie theaters, etc.); and

    (c)

    An interactive entertainment center as defined in this chapter.

    Restaurants operated in conjunction with a regional commercial retail mall are eligible for a full bar liquor license and other liquor licenses as otherwise permitted by this chapter. The restaurant must be open and operating at all times the full bar is operating. Each establishment holding a liquor license shall provide adequate security to ensure that minors are not served or permitted to consume alcoholic beverages anywhere on the premises and that all liquor regulations are complied with.

    Locations holding a full bar liquor license are also eligible for a package beer, wine, and spirits based products liquor license. Regional commercial retail malls are entitled to contain one package liquor license without regard to distance restrictions as otherwise imposed by this chapter. Additionally, the owner/operator of the regional commercial retail mall is eligible for a portable bar liquor license that may be operated in conjunction with special events. If the special event is to be held within the common area of the regional commercial retail mall, a special event permit must be obtained from the department in accordance with the provisions of this chapter governing special event permits.

    A regional commercial retail mall satisfying subsection (1) above is also eligible for three tavern liquor licenses as provided for in Section 8.20.295(d) of this chapter.

    For the purposes of this definition, Resort Entertainment Corridor means the immediate area of Las Vegas Boulevard South ("LVBS") between Sahara Avenue and Russell Road on both the east and west sides of LVBS.
