§ 8.04.135. Addition or deletion of slot machines, live games or other gaming licenses.

  • (A) Once the board has granted a Class C slot machine license or any live game license to a resort hotel or a licensee who is licensed pursuant to Section 8.04.310, the licensee may add or delete the total number of slot machines or live games per each category or any other appropriate gaming license by written notification and payment of quarterly licensing fees to the department. Such notification shall be in accordance with the renewal application provisions of Section 8.04.140 and signature by the licensee of such renewal form shall represent certification of the actual number of slot machines or live games in each category or additional gaming license request. Such license deletions or additions may be granted by the director upon compliance by the licensee with all of the provisions of the Nevada Gaming Control Act (NRS 463, 464, 465 and 466), this chapter and verification of the accuracy of information supplied on the business license application renewal form.

    (B)

    The director shall report the addition or deletion of such slot machines, live games or licenses to the board at the next regularly scheduled meeting of such board at which the item can be legally placed upon the agenda. The licensing board may, by a majority vote, either:

    (1)

    Require further investigation;

    (2)

    Require the applicant to attend a subsequent meeting for a hearing on the proposed modification; or

    (3)

    Deny the increase in the number of slot machines or live games in either category, or additional gaming license request.

    (C)

    If no motion to investigate, conduct a hearing, or deny the modification is made, the number of slot machines or live games as reported on the renewal application form and approved by the director shall be deemed ratified without further action by the board.
