§ 7.09.020. Definitions.

  • Unless the particular provision or the context otherwise requires, the definitions and provisions contained in this section shall govern the construction, meaning and application of words and phrases used in this chapter.

    "Bath" means a washing or soaking of all or part of the human body and includes the techniques and practices commonly referred to as Russian, Turkish, Swedish, hot air, vapor, electric cabinet, steam, mineral, sweat, salt, Japanese, sauna, fomentation or electrical baths of any kind or type whatever, as well as ordinary tub baths, showers, or sweat or steam rooms.

    "Bathhouse" means any place, including a private club or organization, wherein any person engages in, conducts or carries on, or permits to be engaged in, conducted or carried on, the business of giving or furnishing baths of any kind or type whatsoever, including, but not limited to, Russian, Turkish, Swedish, hot air, vapor, electric cabinet, steam, mineral, sweat, salt, Japanese, sauna, fomentation or electric baths. This definition does not include motels, hotels, health clubs, gymnasiums or like establishments where bathing facilities are incidentally provided along with the facilities which serve the normal, central purpose of such establishments, but such establishment must conform to the State of Nevada Public Spa Regulations, adopted November 27, 1979, and last amended January 17, 1996, and pursuant to Nevada Administrative Code, Chapter 444, nor does it include private spa facilities. A bathhouse is subject to the provisions of this chapter and is not deemed to be a massage establishment or massage business, unless operated in conjunction with a massage establishment or massage business, in which case the establishment or business shall be subject to the provisions of both Clark County Code Chapters 7.09 and 7.08 and be appropriately licensed for both services.

    "Bathhouse attendant/employee" means any person who, in the course of any employment with a bathhouse, administers or assists in administering to another human being a bath. Bathhouse attendants/employees must comply with the applicable provisions of this chapter; hold a valid unexpired work card issued by the Las Vegas metropolitan police department (LVMPD); and hold a valid unexpired health card issued by the Clark County health district.

    "Bathhouse manager" means the individual designated by the licensed bathhouse as being responsible for employee supervision and compliance with this chapter. This individual must possess a valid, unexpired work card issued by the LVMPD, and a valid unexpired health card issued by the Clark County health district.

    "Department" means the Clark County department of business license.

    "Director" means the director of the Clark County department of business license.

    "Massage business" means any place wherein massage is an accessory use as defined in Clark County Code Chapter 7.08. "Massage establishment" means any fixed place of business wherein the practice of massage provides the primary source of income or compensation for the business as defined in Clark County Code Chapter 7.08. "Person" includes any association, corporation, firm, partnership, trust or other form of business association as well as a natural person.

    "Premises" means the portion of the building in which the licensee is located and over which he/she has control as owner or lessee. For the purposes of a resort hotel, "premises" shall be defined as set forth in Clark County Code Chapter 8.04. "Principal" means any individual; or, if a corporation, or limited liability company, each stockholder, or member owning or controlling ten percent or more of the stock or ownership of the corporation or limited liability company and each member, officer and director thereof; or, if a partnership, each partner; or, if an unincorporated association or other business entity type, each and every member/manager/owner/director thereof.

    "Private spa" means any spa at a single-family private residence which is controlled by the homeowner, the use of which is limited to swimming or bathing by members of the family or invited guests pursuant to Nevada Administrative Code Chapter 444. "Resort hotel" shall be defined as set forth in Clark County Code Chapter 8.04.
