§ 5.04.270. Force majeure.

  • In the event a franchisee's performance of any of the terms, conditions or obligations required by this chapter or franchise agreement is prevented by a cause or event beyond the control and without the fault or negligence of the franchisee, including but not restricted to, acts of God, acts of another franchisee, epidemics, quarantine restrictions, freight embargoes, explosions, strikes, sabotage, riots or civil disturbances, acts of public enemies, unusually severe weather and natural disasters such as floods, earthquakes, landslides, and fires, such inability to perform shall be deemed excused and no penalties or sanctions shall be imposed as a result thereof. Delays of agents, subcontractors or suppliers of any tier are recognized to be within the franchisee's control unless the agent's, subcontractor's or supplier's failure to perform is attributable to the above listed excusable causes.
