§ 20.13.100. Board of adjustment.

  • (a) There is established a board of adjustment which shall have and exercise the following powers:

    (1)

    To hear and decide appeals from any order, requirement, decision or determination made by the director of aviation in the enforcement of these regulations as provided in Section 20.13.110;

    (2)

    To hear and decide specific variances under Section 20.13.080.

    (b)

    The board shall consist of five members, each to be appointed for a term of three years by the board of county commissioners, and shall be removable by the board of county commissioners for cause, upon written charges and after public hearing. None of them shall be members of the board of county commissioners or the director of aviation.

    (c)

    The concurring vote of a majority of the members of the board shall be sufficient to reverse any order, requirement, decision or determination of the director, or to issue a variance as provided by Section 20.13.080.

    (d)

    The board shall adopt rules and procedures in accordance with these regulations for the purposes of carrying out its responsibilities under these regulations, including fixing the time and manner for appeals, applications for variances and the proceedings before the board, consistent with this chapter.

    (e)

    Meetings of the board shall be held at the call of the chairman and at such other times as the board may determine.

    (f)

    The chairman, or in his absence the acting chairman, may administer oaths and compel the attendance of witnesses.

    (g)

    All hearings of the board shall be public.

    (h)

    The board shall:

    (1)

    Keep minutes of its proceedings, showing the vote of each member upon each question, or, if absent or failing to vote, indicating such fact;

    (2)

    Keep records of its examinations and other official actions, all of which shall immediately be filed in the office of the board and shall be a public record.
