§ 20.13.020. Definitions.

As used in this chapter, unless the context otherwise requires:

"Airports" means the McCarran International Airport and the North Las Vegas Air Terminal, located in Clark County, Nevada.

(2)

"Airport hazard" means any structure or tree or use of land which obstructs the airspace required for the flight of aircraft in landing or taking off at the airport, or is otherwise hazardous to the landing or taking off of aircraft.

"Airport hazard area" means any area of land or water upon which an airport hazard might be established if not prevented, as established under Section 20.13.030.

(4)

"Airspace zoning maps" means (A) the McCarran International Airport Airspace Zoning Map, consisting of five sheets prepared by the Clark County airport engineering department, dated July 18, 1990, and adopted by Ordinance 1221, together with the McCarran International Airport Aircraft Departure Critical Area Map, consisting of one sheet prepared by the Clark County airport engineering department, dated February 2, 1993, and adopted with the ordinance codified in this chapter; and (B) the North Las Vegas Air Terminal Airspace Zoning Map, consisting of one sheet prepared by the Clark County airport engineering department, dated July 18, 1990, and adopted by Ordinance 1221.

"Board" means the board of adjustment to be created pursuant to these regulations.

"Director of aviation" means the director of the Clark County department of aviation.

(7)

Height. For the purpose of determining the height limits in all zones set forth in this chapter and/or shown on the airspace zoning maps, the datum shall be mean sea level elevation.

"Nonconforming use" means any preexisting structure or use which is inconsistent with the provisions of this chapter or an amendment thereto, or any proposed structure or use which is inconsistent with the provisions of this chapter or an amendment thereto, provided that construction of such structure or commencement of such use was begun prior to the effective date of this chapter (A) after obtaining all requisite governmental approvals and authorizations and the passage of time limits prescribed for appeal or challenge to such approvals and authorizations without any such appeal or challenge having been taken; and (B) in good faith reliance on a final, valid building permit permitting the specific construction and provided further that, pursuant to such permit, substantial sums, not including costs for engineering, architectural, legal or other such services, investigations, designs or studies, have been expended for actual on-site construction.

"Person" means an individual, firm, partnership, corporation, company, association, joint stock association, or governmental entity; includes a trustee, a receiver, an assignee, or a similar representative of any of them.

(10)

"Runway" means the areas on either airport prepared for landing and takeoff of aircraft along its length.

(11)

"Structure" means an object, including a mobile object, constructed or installed by man, including but without limitation, buildings, towers, cranes, smokestacks, earth formation, signs and overhead transmission lines.

(12)

"Tree" means any object of natural growth.
