§ 20.04.090. Marijuana prohibited.

  • (a) It shall be unlawful to:

    (1)

    Possess, consume, use, display, transfer, distribute, sell, transport, or grow marijuana in or upon any airport or any property or facility owned by the department of aviation, including, but not limited to, any buildings, land, structures, terminals, parking and ground transportation facilities, roadways, air operations areas, hangars, warehouses, offices, or commercial properties; or

    (2)

    Advertise a marijuana-related business or establishment in or upon any such airport or property or facility owned by the department of aviation.

    (A)

    The advertisement prohibition in this section does not apply to vehicles being operated within the scope of the terms of a permit issued by the department of aviation.

    (B)

    The advertisement prohibition in this section does not apply to the incidental advertisement of marijuana on vehicles being used by patrons of an airport, such as utilization of a paid parking space within the airport's passenger parking facilities by a ticketed passenger, or a vehicle being used for a brief period solely to drop off or pick up a ticketed passenger.

    i.

    "Incidental advertisement" does not include advertisements on vehicles which are cruising on airport facilities or loitering in airport parking facilities and which do not fall into (2)(A) or (B) above.

    (b)

    For the purposes of this chapter, the term "marijuana" shall have the meaning ascribed to it in NRS 453D.030.

    (c)

    Penalties for violations of this section 20.04.090 are as follows:

    (1)

    Any person who violates this section shall be guilty of a misdemeanor or civil fines, or both a misdemeanor and civil fines.

    (2)

    The director of aviation shall issue an operating directive setting the amounts of all civil fines authorized under this section.
