§ 14.40.045. Notice and removal deadline—When towing allowed.

  • (a) Any officer of the Las Vegas metropolitan police department or Clark County code enforcement officer who has reasonable grounds to believe that an abandoned vehicle, trailer, recreational vehicle, commercial vehicle, or mobile billboard is in violation of Section 14.40.043 may affix a warning notice advising that the vehicle:

    (1)

    Is in violation of Section 14.40.043; and

    (2)

    Is subject to being towed pursuant to the provisions of Section 14.40.045 if not removed within seventy-two hours after a warning notice is affixed.

    (b)

    When affixing the warning notice, the officer may mark one or more tires of the abandoned vehicle, trailer, recreational vehicle, commercial vehicle, or mobile billboard to indicate the current date.

    (c)

    Moving of the abandoned vehicle, trailer, recreational vehicle, commercial vehicle, or mobile billboard short distances with the intent of avoiding the seventy-two-hour time limitation is insufficient to comply with the requirements of this section.

    (d)

    In addition to any other penalty provided for a violation of a county ordinance, if the abandoned vehicle, trailer, recreational vehicle, commercial vehicle, or mobile billboard is not removed within seventy-two hours after a warning notice is affixed, the officer may remove it or cause it to be removed by a tow car operator.

    (e)

    The towing of any abandoned vehicle, trailer, recreational vehicle, commercial vehicle, or mobile billboard in accordance with the provisions of this section shall be at the expense of the owner. The tow car operator shall, to the extent practicable and using the shortest and most direct route, remove the abandoned vehicle, trailer, recreational vehicle, commercial vehicle, or mobile billboard to the closest facility of the tow car operator unless directed otherwise by the officer.

    (f)

    A vehicle found in violation of Section 14.40.043(a) or (b) shall be considered abandoned pursuant to Nevada Revised Statutes chapter 487 or its successor. A constable's office shall be authorized to enforce the provisions of Section 14.40.043(a) and (b) in the manner provided by Nevada Revised Statutes Chapters 484B and 487 and this section and collect any fee for such enforcement authorized by Nevada Revised Statutes Section 258.125.
