§ 12.34.060. Construction on property of another.

  • (A) It is unlawful for an owner, lessee or possessor of premises to erect any barrier or fence upon the land of another for the purpose of preventing access to the premises of the premises of the owner, lessee or possessor unless by agreement between the owner of the property upon which the barrier or fence is erected and the erector.

    (B)

    In the event of such agreement as specified in subsection (A) of this section, the owners, lessees or possessors of both premises are both liable to maintain markers thereon.

    (C)

    It is unlawful for the owner, lessee or possessor of premises to unreasonably allow such an unmarked barrier or fence to exist on his property.
