§ 12.34.010. Definitions.

  • As used in this chapter, the following words and phrases shall have the meanings ascribed to them in this section:

    (A)

    "Fence" means a fence with not less than four horizontal barriers, consisting of wires, boards, poles or other fence material in common use in the neighborhood, with posts set not more than twenty feet apart. The lower barrier shall be not more than twelve inches from the ground and the space between any two barriers shall be not more than twelve inches and the height of top barrier must be at least thirty-six inches above the ground.

    (B)

    "Barrier" includes, but is not limited to, woven metal cable, link chains, rope, nylon line or rope, or other similar barrier material which is not marked and less than ten feet above ground.

    (C)

    "Trail" means a strip of land or pathway appropriated and used for purposes of travel.

    (D)

    "Unmarked," as respecting barriers on trails, means those not marked and which cannot be seen at a distance of one hundred feet.

    (E)

    "Vehicle" includes, but is not limited to, motor vehicles, motorbikes, minimotorbikes, bicycles, and snowmobiles.

    (F)

    "Recreational uses" includes, but is not limited to, horseback riding.

    (G)

    "Daylight hours" means the period of time between sunrise and sunset.
