§ 12.32.030. Violations—Penalty.

  • Any person violating any of the provisions of Section 12.32.020 is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than five hundred dollars or by imprisonment in the county jail for a term of not more than six months, or by any combination of such fine and imprisonment; provided, however, any person violating the provisions of subsection (b) or (c) of Section 12.32.020 shall be punished by a fine of not less than two hundred fifty dollars upon conviction of the first offense; upon being convicted of a second violation of said subsections within three years the person shall be punished by a fine of not less than the sum of two hundred fifty dollars and by imprisonment in the county jail for a term of not less than thirty days; and upon being convicted of three or more violations of said subsections within three years the person shall be punished by a fine of not less than two hundred fifty dollars and by imprisonment in the county jail for a term of six months, all such sentences to run consecutively. Whenever in this chapter any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in such chapter the doing of any act is required or the failure to do any act is declared to be unlawful or a misdemeanor, the doing of any such prohibited act or the failure to do any such required act shall constitute a violation of this chapter. Each day of any violation of this chapter constitutes a separate offense.
