§ 11.09.020. Definitions.

  • As used in this chapter, unless the context otherwise requires, the words and terms have the meanings ascribed to them in this section. Words used in the present tense include the future, words in the singular number include the plural and the plural the singular.

    (a)

    "Board" means the board of county commissioners of Clark County, Nevada.

    (b)

    "Code" means the Uniform Housing Code, as adopted by the county pursuant to Title 22 of the Clark County Code.

    (c)

    "County" means Clark County, Nevada.

    (d)

    "Division" means the department of finance, community resources management division of Clark County, Nevada.

    (e)

    "Encumbrance" means any claim, lien, charge or liability attached to and binding upon real property, but shall not include easements, rights-of-way, real covenants or equitable servitudes.

    (f)

    "Fund" means a revolving fund for loans for the rehabilitation of residential property as established pursuant to this chapter.

    (g)

    "Household gross income" shall be defined per the Department of Housing and Urban Development's Home Investment Partnership Program ("HOME"), 24 CFR Part 92, subsection 92.203, Income Determinations, paragraph (b)(1).

    (h)

    "Household size" or "household" means the number of individuals who reside primarily in the home of the applicant. If a person lives in the household and pays rent by contract or agreement, he is not a part of the household. If a person lives in the household and does not pay rent, he is considered a part of the household.

    (i)

    "Housing expenses" means the sum of:

    (1)

    Monthly mortgage(s) payments;

    (2)

    Homeowner insurance;

    (3)

    Real estate taxes; and

    (4)

    Monthly utility charges (heat, lights, electricity, and basic telephone services).

    (j)

    "Neighborhood preservation area" means a portion of the unincorporated area of the county which may be designated by the board from time to time as locations in which property will be eligible for rehabilitation loans, a map of which shall be placed on file in the county clerk's office.

    (k)

    "Property" means the residential land and improvements thereon for which an individual seeks or is granted a rehabilitation loan.

    (l)

    "Rehabilitation" includes structural improvements, landscaping, and any other measure to improve the appearance of property and maintain property in a decent, safe and sanitary condition per code.

    (m)

    "Rehabilitation loan" means a loan issued pursuant to this chapter.
